Terms & Conditions

  1. Customer and Affordable Funeral Supply, LLC, the (“Seller”) of merchandise described on all sales agree to be bound by all terms and conditions governing the purchase and sale of the merchandise described on every invoice (the “Merchandise”), including the Terms and Conditions of Sale incorporated herein, all of which are a part of every sale and should be carefully read. Any provisions in the Customer’s purchase orders, invoices, billing statements, acknowledgment forms or similar documents which are inconsistent with the provisions of any sale shall be deemed waived by Customer and are of no force or effect.
  2. Seller shall not be liable due to late delivery or non-delivery caused by war, demands or requests of governmental authority, national defense, civil commotion, strike, labor trouble, fire, flood, accident, failure in merchandise or production equipment, inability to obtain fuel, power, raw materials or shipping capacity, delays on drop ship merchandise due to manufacturer’s timetables that are outside of seller’s control, or other causes beyond the reasonable control of Seller. If resulting delay occurs, shipments may be proportionately or wholly suspended and resumed upon removal of such cause. Quantities so affected may be eliminated from the order without liability, but the order shall remain otherwise unaffected.
  3. All delivery dates quoted are estimates only. All freight and delivery charges from Seller's or manufacturer’s warehouse shall be paid as a separate item and are not included in Seller's price unless specifically so stated. Seller has option to make partial deliveries and Customer shall accept these unless otherwise specifically agreed to by Seller.
  4. The purchase price for the Merchandise shall be paid in accordance with the terms set forth on every invoice. In the event Customer fails to fulfill the terms of payment, or in case Seller shall have any doubt at any time as to Customer's financial responsibility, Seller may decline to make further deliveries, except upon receipt of cash or satisfactory security. Past due balances are subject to a late payment charge of 1.5% per month, or the maximum amount permitted by applicable law, whichever is less. Customer shall pay all costs, fees, including attorney's fees, and expenses incurred by Seller in collecting monies due or to become due hereunder, regardless of whether a lawsuit is filed. All sales shall be deemed to take place at the applicable Seller’s, or manufacturer’s distribution facility, and both the transfer of title for shipped/purchased Merchandise and the risk of loss for said Merchandise shall be deemed to take place at the applicable Seller’s or manufacturer’s distribution facility.
  5. All sales are considered final once the buyer confirms the order, whether in writing, electronically, or through payment. By confirming the sale, the buyer acknowledges and agrees to be bound by Affordable Funeral Supply’s Terms and Conditions, which govern all aspects of the transaction. No changes or cancellations will be accepted after confirmation, except as explicitly stated in these Terms. Payment is due in full as specified on the invoice and is non-cancellable and non-refundable once the order has been confirmed by the buyer. By confirming the order—whether by signature, written communication, or electronic approval—the buyer agrees to pay the total amount due and acknowledges that the order may not be altered or canceled. Failure to remit payment in accordance with these terms may result in delayed fulfillment, additional fees, or legal action.
  6. Orders for stock (non-custom) merchandise may be canceled only if the cancellation request is received and confirmed by Seller before the order has been shipped. Once the order has been shipped, it may no longer be canceled and must be handled in accordance with our Return Policy. Cancellation requests must be submitted in writing and are not effective until acknowledged by us in writing. Orders for non stock (or custom) merchandise may not be canceled once production or manufacturing has commenced. Requests to cancel an order for non stock (or custom) merchandise must be submitted in writing and are subject to approval at the sole discretion of seller. If cancellation is approved prior to the start of production, a cancellation fee may apply, and any non- refundable deposit or prepayment made at the time of order will be forfeited. Custom or made-to-order merchandise is non-cancellable and non-refundable once the order has been confirmed and production has begun.
  7. Only select merchandise is eligible for return. In the event of an approved return, the buyer is responsible for all return shipping costs and any applicable restocking fees, unless the return is due to an error on the part of seller. Restocking fees may range from 10% to 40% of the original purchase price, depending on the condition of the returned merchandise, the nature of the product, and the restock fees that merchandise manufacturer’s charge (on drop ship merchandise). Original shipping charges are non- refundable. Merchandise that is eligible for a return must be returned in its original condition and packaging. Seller must be notified within 2 days of delivery that customer would like to have a return authorized. If seller agrees to authorize a return, a return authorization number will be issued with directions on how to proceed with the return. All returns are subject to prior approval by seller. Non-returnable merchandise includes but is not limited to: customized or personalized products, products made to order or otherwise modified at the buyers request, perishable goods, final sale or clearance merchandise, opened or used merchandise, merchandise that could potentially come in contact with a deceased individual. By placing an order for such merchandise, the buyer confirms all specifications and assumes responsibility for the accuracy of the information provided. All non-returnable merchandise is non-refundable. We reserve the right to refuse any return that does not comply with any of these conditions.   8. In the case of defective merchandise, customer must make seller aware within 2 days of delivery, along with supporting evidence (e.g., photos, descriptions). Merchandise will be considered defective only upon inspection and confirmation by Affordable Funeral Supply, LLC. We reserve the sole right to determine whether a product is defective and whether a repair, replacement, credit, or refund is warranted. All defective Merchandise must be held by customer until seller provides instructions how to return or dispose of merchandise.
  9. Invoice Adjustment Policy: Customer must refuse all damaged or Merchandise shipped in error at the time of receiving said Merchandise. Customer must note all shortages/damage and other discrepancies at time of the Merchandise’s delivery and include: 1) an exact count of the Merchandise that was not received or was damaged, 2) Customer’s or consignee’s signature, 3) confirmation of Merchandise’s delivery. If Customer or consignee signs a delivery receipt with no exceptions it acknowledges receiving a complete shipment. Customer must report all receiving discrepancies to Seller’s service department within 48 hours of Merchandise delivery date (phone 877-446- 0191 or email [email protected]). Failure to fulfill terms of this policy may result in invoice adjustment being declined. Failure of Seller to receive written notice of any such claim within the applicable time period shall be deemed an absolute and unconditional waiver by Customer of such claim irrespective of whether the facts giving rise to such claim shall have been discovered or whether processing, further manufacture, other use or resale of the Merchandise shall have taken place.
  10. It is understood and agreed that Seller's liability whether in contract, tort, warranty, negligence or otherwise shall not exceed the amount paid by Customer. Under no circumstances shall Seller be liable for special, indirect or consequential damages. The price stated on the invoice for the purchased Merchandise is a consideration limiting Seller's liability. No action, regardless of form, arising out of the transactions under this of any sale may be brought by Customer more than one year after the cause of action has accrued. Customer acknowledges that with the purchase of merchandise described on each invoice, Seller shall have no liability for Customer’s illegal or criminal use of said merchandise, and Customer shall indemnify and hold harmless the Seller if Seller is named in any relevant litigation.
  11. WARRANTIES. IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT THE SELLER SHALL NEVER BE HELD TO BE OBLIGATED OR LIABLE UPON OR UNDER ANY GUARANTIES OR WARRANTIES, EXPRESS OR IMPLIED, STATUTORY, BY OPERATION OF LAW, OR OTHERWISE INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS UNDER ANY STATE’S UNIFORM COMMERCIAL CODE IN ANY MANNER OR FORM. CUSTOMER IS MAKING THIS PURCHASE AFTER AND IN RELIANCE ON ITS FULL AND COMPLETE EXAMINATION OF THE MERCHANDISE, AND NOT BY REASON OF ANY REPRESENTATION AS TO ITS MERCHANTABILITY, SPECIFIC ATTRIBUTES OR OTHERWISE, MADE BY OR ON BEHALF OF THE SELLER.
  12. Seller's failure to insist upon performance of any of the terms and conditions herein, or to exercise any right or privilege, or Seller's waiver of any breach hereunder shall not thereafter waive any of the terms, conditions or provisions, whether of the same or similar type.
  13. The invalidity, in whole or in part, of any provisions hereof shall not affect the validity of any other provision.
  14. This Agreement is not assignable or transferable by Customer, in whole or in part, except within the written consent of Seller.
  15. When in the opinion of Seller there is a period of shortages of supply of Merchandise for any reason, Seller may allocate its available supply among any or all of its various Customers upon such basis as Seller shall deem fair and practicable, with no liability on its part for failure to deliver the quantity or any portion therein specified.   16. Customer may not list or resell any Seller’s Merchandise on any online 3rd party market place, without Seller’s prior consent.
  17. If Customer is an authorized distributor for the Seller, and has a current Distribution Agreement with the Seller, Customer agrees to adhere to all of the obligations described in its Distribution Agreement.
  18. These Terms and Conditions and any transactions between the buyer and Affordable Funeral Supply, LLC shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Allegheny County, Pennsylvania.
